SUMMARY:
Janson McClanahan has requested the closure of approximately 300' of Lillian Court that lies between his two parcels.  This public right-of-way has not been developed.  As shown on the attached map, there are existing undeveloped right-of-ways that will remain to access all other properties and will not be affected with this closure.
      Following further review by the City Attorney, consents will not be required since all of Lillian Court is not being closed.  Mr. McClanahan owns the parcels on either side of the portion that is being closed by this ordinance.  The remaining portion of Lillian Court will remain public right-of-way and can be developed for use by the property owners that are adjacent to it.
      One property owner, Darryl Cole, has come forward voicing his concerns over the closure of a portion of Lillian Court. He believes that the loss of "access" to Old Jamestown Highway will be a loss of value to his property. His property does front on Old Jamestown Highway and he would still have access to the remaining ROW and could construct a driveway or road to intersect with HWY 127 (pending approval from TDOT and the City of Crossville). Mr. Cole also stated his concerns about the possibility of subdividing his lot in the future and not being able to do so without the access to Old Jamestown Highway from the rear of the property. It was explained to Mr. Cole by staff, that the ROW that possibly touches his property would still be in existence, and he would still have access to the property by the remaining ROW to HWY 127 or do a "flag lot" type subdivision to have both parcels access Old Jamestown Highway.
