SUMMARY: The property owners of Tax Map 139 Parcel 070.02 are proposing a two-lot subdivision. The proposed Lot 2, consisting of 1 acre, does not front on Highway 127 South. They are requesting a variance for the required road frontage. The have a 25-foot ingress/egress/utility easement crossing Lot 1 to the benefit of Lot 2. The owner of Lot 1 wishes to keep ownership of the existing driveway while cutting a lot for a family member.

 

STAFF RECOMMENDATION: Staff recommends approval of the variance. The Planning Commission has granted multiple variances of this kind in the past. Staff does feel that a precedent has been set and has made a note to recommend a change in the existing subdivision regulations to allow for private easement in lieu of road frontage for simple 2 lot subdivisions. Any future subdivisions of the property may require a public road be constructed to be in compliance with the subdivision regulations.

NECESSARY PLANNING COMMISSION ACTION: Two Motions: First, approve the variance. Second, approved the plat.
