Discussion and action on Northside Drive Drainage

SUMMARY: The City was contacted by Bruce Blessing, owner of Pipe Line Utility Contractors, LLC (PUC), in March of this year. Mr. Blessing was investigating the storm sewer on the Bojangles’ property for Bojangles. He discovered that a plastic culvert had collapsed and he believed that it had occurred because of the excessive amount of fill installed above the culvert. The culvert is shown in green on the attached TDOT plan. The size of the culvert is 36 inch and it is approximately 34 feet long with 22 feet being located on the City and 12 feet located on Bojangles’ property. The Bojangles’ portion of the culvert is the deepest portion of the culvert at approximately 24 feet of depth.

Claude Clark with Bojangles’ then contacted the City about the collapsed culvert and relayed the price quote from PUC. After City staff investigated the issue, Mr. Clark was too busy dealing with storm damage, at other Bojangles’ facilities, to discuss the issue.

Mr. Clark later contacted the City at the end of June to discuss the issue. The attached email (proposal) was then sent to Mr. Clark. Weeks later a phone conversation was had with Mr. Clark and he said that the issue had been turned over to the Bojangles’ legal team and they should have already contacted the City. As of October 1st, the Bojangles’ legal team has not contacted the City and the Director of Engineering contacted Mr. Clark again by telephone. Mr. Clark stated that Bojangles did not like the City’s proposal and that is why it has been turned over to their legal team.
