SUMMARY: The developer is proposing demolishing the existing Murphy Oil canopy, pumps, and existing building that is located on an outparcel in front of Walmart, located off HWY 127 N. They are planning to construct a larger store, add additional pumps, and relocate the underground fuel tanks. They are requesting a variance to the required setbacks for the new store building as well as the canopy and pumps. HWY 127 being an arterial highway, it requires a 50-foot setback with standard 10-foot sides and rear.
STAFF RECOMMENDATION: Staff recommends approval of the site plan and the variances for setback encroachment. The ROW of HWY 127 in that area is much larger than the standard ROW of state highways and due to the elevation change from the HWY to the site, Staff cannot see an impact to public safety by allowing the reduced setback. The existing canopy and building are well inside the required 50-foot setback.

NECESSARY PLANNING COMMISSION ACTION: Approve the site plan with variances.
