The Gardens Phase VI Lot 11 - Side Setback Variance Request

SUMMARY: The property owner is requesting a side setback variance of 5 feet. The current setback is 15 feet. This would reduce the side setback to 10 feet. Side setbacks for standard lots are 10 feet with zero lot line lots being 15 feet. Throughout Phase VI of The Gardens, the developer used the standard setback of 15 feet for their zero lot line parcels. Since then, the developer requested and has been granted a variance for the side setbacks to be 10 feet.

 

STAFF RECOMMENDATION: Staff recommends approval of the variance request. Since all phases of the Gardens have side setbacks of 10 feet and the adjacent property has a house constructed on it, with the side setback of 15 feet, staff can see no reason not to grant the variance.
