Lowe’s Out Parcel Subdivision with Variance Request - Final Plat

SUMMARY: Lowe’s is proposing a 0.55 acre lot be cut off from their remaining property. The proposed “out parcel” will not front the public right-of-way or public utilities. They are requesting a variance to the requirement and including an ingress/egress and utility easements as a solution.
STAFF RECOMMENDATION: Staff recommends approval of the plat, subject to owners signatures. It is standard practice for many commercial developments to have outparcels without true public right-of-way access and have proper ingress/egress and utility easements in lieu of the fronting of ROW. The attorneys, representing Lowe’s, have requested the plat be approved before the owners sign the plat. This is something that the City’s Planning Commission has allowed in the past. Once the owners sign the plat, it will be mailed to the City Planning staff for the remainder of the signatures and the recording of the plat.
