SUMMARY: Mr. Russell is proposing a three-lot subdivision along Highway 70 North. The proposed three lots consist of lot line adjustments of existing lots and the creation of new lots. Lot 2 and Lot 3 front on Highway 70 North and have existing water. The proposed Lot 1 will require a variance for ingress, egress, and utility access. The reasoning for the variance request is that Mr. Russell wishes to maintain ownership of the access point for the possibility in the future to subdivide the remaining property, which is currently greater than 5 acres, into more lots for his family. In the event of a future subdivision, he would be required to construct a public road as well as public utilities. If the proposed Lot 1 was a flag lot, then it could hinder any future plans.

 

STAFF RECOMMENDATION: Staff recommends approval of the plat with variance, contingent upon owner’s signature and TDEC signature with restrictions. Due to a delay in receiving the proper restrictions from TDEC and conversations had with the surveyor, staff feels confident that all lots will be approved, based on soil testing.

 

Recommended Action

NECESSARY PLANNING COMMISSION ACTION: Two Motions: First, approve the variance allow an easement in lieu of road frontage and utility access. Second, approve the plat.
