Resolution requesting repeal of preemption of local smoke-free air and other tobacco-related laws

SUMMARY:
The American Cancer Society Cancer Action Network is working with American Heart Assn., American Lung Assn. Tobacco Free Kids, and Americans for NonSmoker’s Rights to launch a campaign to repeal the state’s tobacco preemption policy, so communities can expand protection from exposure to second-hand smoke where they deem it needed. That policy prevents local authorities from passing laws to create smoke-free policies where they are allowed under exemptions to the TN NonSmoker’s Protection Act.
Attached is a Resolution asking the General Assembly to allow local authority to strengthen community smoke-free standards. The American Cancer Society is urging local municipalities to pass resolutions urging the General Assembly the repeal of the preemption laws. So far, the cities of Alamo and Cookeville have passed resolutions and other communities are in the process.
They have sponsors in the House and Senate who will file a bill to repeal preemption next session and are told by House leadership that the need must be demonstrated by local communities. Some are making specific requests for amending out certain events, areas, etc., while others are simply considering or planning to present the Resolution for passage in their community. The attached resolution specifically requests the right for the buildings, parks, and venues that are owned and operated by the City.
