Ordinance replacing § 16-200 of the Crossville Municipal Code regarding excavation and cut fees in public right-of-way

SUMMARY:

The current ordinance on excavations and cuts has not been reviewed and revised in over 30 years.  A team consisting of Tim Begley, Kevin Music, Kevin Dean, Billy Martin, Lee Lawson, and Sally Oglesby has been working on totally rewriting this ordinance to reflect current and future projects and issues.  The ordinance has been reviewed by the City Attorney for form and legality.  As discussed at the meeting on March 14, the ordinance has been revised regarding masonry columns and mailboxes to require them to be 3 1/2’ off the hard surface.  The guidelines from the USPS for installation of a mailbox are attached.

 

Regarding current improvements on the right-of-way such as masonry columns and mailboxes, the City will generally do its best to return the area to its original condition.  However, some improvements will not be able to be completely restored.  Each issue will be a case-by-case decision dependent on the work to be done.  Generally, in the case of new waterlines or sewer lines, a bore will be done under the improvement to avoid removal. 

 

The team recommends adoption of the new revised ordinance.
