Discussion and action on sewer line easement for Munro Smith Properties, LLC

SUMMARY: The City has a dedicated sewer line and easement, which is currently in use, and is located underneath the slab of the Kmart building. It was discovered on a recent ALTA survey by the Purchaser. The easement states that the sewer line will be left alone. Also states that if, in the future, it fails, then, instead of disturbing the slab and structure, the City would abandon that part under the building and, at its expense, construct a by-pass line in the easement being conveyed in this document. Exhibits for the easement will be provided at the meeting and will also be subject to City staff approval.
