SUMMARY: The owner/developer, Mr. Pelfrey, is proposing a simple lot line adjustment. The lot already exists and Mr. Pelfrey owns it and the property surrounding it. He is proposing an adjustment of the lot lines to match an existing fence. Since the requirements of the Planning Regulations do require soils test and the signature of the state environmentalist, a variance is being requested. Since the existing lot is gaining property, the requirement for a backup system area should not be needed.

 

STAFF RECOMMENDATION:  Staff recommends approval of the plat and variance, due to the original lot is gaining property and not losing it.
